Terms of Service

Thank you for choosing our products and services ("Services"). These Services are offered by Codelight Infotech Private Limited, the proprietor of the CLIJob platform ("CLIJob"). By utilizing our Services, you agree to adhere to these terms. We encourage you to review them thoroughly. Given the diversity of our Services, there may be occasions where additional terms or product specifications are applicable. Such additional terms will be provided alongside the respective Services, and by utilizing those Services, you incorporate those additional terms into your agreement with us.

1. Use of Services

1.1 You must be at least 18 years old or have the consent of a legal guardian to use our Services.

1.2 You agree to use our Services only for lawful purposes and in accordance with these Terms and all applicable laws and regulations.

2. User Content

2.1 You retain ownership of any content you submit, post, or display on or through our Services ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with our Services.

2.2 You agree not to submit User Content that is unlawful, defamatory, obscene, abusive, offensive, or otherwise violates any party's rights.

3. Fees and Payment

3.1 As a pharmacy or clinic, you agree to cover the expenses for the services provided by Pharmacy or Clinic Professionals (such as Pharmacists, Pharmacy Technicians, Pharmacy Assistants, Dental Hygienists, and Dental Assistants) through your account. This includes the platform/administrative fee (outlined below) for every relief shift scheduled via the CLIJob Platform.

3.2 The relief shift fees include the hourly rate for services provided by a Pharmacy or Clinic Professionals, along with any relevant local taxes.

3.3 By booking Relief Shifts through the CLIJob Platform, you agree to pay CLIJob a Platform/Administrative Fee for each booked shift. This fee grants you access to book Relief Shifts through the CLIJob Platform.

3.4 You must pay Relief Shift Fees directly to pharmacy or clinic professionals at the time of the Relief Shift. Additionally, Pharmacy or Clinic is responsible for paying Platform/Administrative fees to CLIJob upon confirming the Relief Shift.

3.5 If you are a pharmacy or clinic professional, your pharmacy or clinic will reimburse you for any relief work services that you provide and that you have accepted through your CLIJob Account.

4. Payment Method/Refund Policy

4.1 We utilize a third-party payment processing provider for handling platform/administrative fees. By using our services, you grant the Payment Processor permission to collect, utilize, and disclose your personal information for processing payments.

4.2 You acknowledge and agree that the Payment Processor may also gather personal information and/or other data about you, subject to the rules outlined in the Payment Processor's privacy policy, if applicable.

4.3 You understand and acknowledge that sharing your personal information with the Payment Processor does not impose any additional obligations on us to you. Furthermore, no refunds will be provided to the Pharmacy in the event of subpar service quality once a Relief Shift has been accepted and completed by a Pharmacy or Clinic professional.

However, subsequent to a relief shift, the pharmacy retains the option and authority to rate the pharmacist or technician via the CLIJob Platform.

5. Cancellation Policy

5.1 As Pharmacy: You may choose to end a relief shift before it begins, but cancellation fees apply as follows:

- Free cancellation if made at least 10 days before the Relief Shift date.

- Cancellation between 4 and 10 days before the Relief Shift incurs a fee of $100.

- Cancellation within 72 hours of the Relief Shift results in the full amount of the relief shift fee plus administrative fee being charged.

- A Relief Shift may be canceled at any time without a cancellation charge if it has been offered but you have not accepted a Pharmacy or Clinic professionals to fill it.

5.2 As Pharmacy or Clinic professionals Prior to the start of a Relief Shift, you may cancel with the following fees:

- Free cancellation if made at least 10 days before the Relief Shift date.

- Cancellation between 4 and 10 days before the Relief Shift incurs a fee of $100.

- Cancellation less than 72 hours before the Relief Shift costs $200.

Repeated cancellation of Relief Shifts or actions compromising service integrity may result in expulsion from the CLIJob Platform.

6. Relief Shift Schedule modification

6.1 In the event that the Relief shift schedule undergoes modifications after confirmations by any parties (Pharmacy/Clinic or Professional), both parties are expected to understand and mutually compensate. CLIJob will not bear responsibility for any schedule changes.

7. Intellectual Property Rights

7.1 All content, copyrights, trademarks, domains, logos, trade dress, trade secrets, patents and other intellectual property rights related to our Services are owned by us or our licensors. You may not use, copy, reproduce, distribute, modify, or create derivative works of any such content without our prior written consent.

8. Disclaimer of Warranties

8.1 At CLIJob, we continuously enhance our services, introducing new features and functionalities while occasionally discontinuing or suspending certain services. You have the freedom to cease using our services anytime, although we'll regret losing you. CLIJob reserves the right to cease providing services to you or impose new limitations at any time. We value your data ownership and prioritize your access to it. In the event of service discontinuation, we'll provide reasonable advance notice and assist you in retrieving your data.

8.2 The Site and/or the App is provided on an as-is, as-available basis. You agree to use the Services at your own risk. We disclaim all warranties, including merchantability and fitness for a particular purpose. We are not liable for:

- Errors or inaccuracies in content.

- Personal injury or property damage from Platform use.

- Unauthorized access to our servers or data.

- Interruption of Platform transmission.

- Third-party transmission of viruses.

- Errors in content causing loss or damage.

We don't endorse or assume responsibility for third-party services advertised on the Platform. Use caution in transactions.

9. Limitation of Liability

9.1 To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of or inability to use our Services.

10. Governing Law

10.1 These Terms shall be governed by and construed in accordance with the laws of Gujarat, India, without regard to its conflict of law provisions.

11. Changes to Terms

11.1 We reserve the right to modify or update these Terms at any time without prior notice. Any changes will be effective immediately upon posting. Your continued use of our Services after any such changes constitutes acceptance of the modified Terms.
